Ctg ACC official transfer: HC reveals incident of fraud in its order, asks for probe
A High Court bench today revealed an incident of fraud with its order regarding transfer of Md Sharif Uddin, a deputy assistant director of the Anti-Corruption Commission (ACC) in Chattogram and also ordered the commission to conduct an investigation.
Sharif Uddin, who had reportedly been conducting investigations into corruption allegations against different offices and hospitals in the district, was transferred on June 17 this year.
The HC bench led by Justice M Enayetur Rahim and Justice Md Mostafizur Rahman on June 30 this year summarily rejected a writ petition that sought stay on the transfer of Sharif Uddin. One Fozle Azim Mohammad Sibgatullah had filed the writ petition.
But a lawyer named Md Mazharul Haque issued an advocate-certificate saying that the HC bench of Justice Enayetur Rahim on July 29 this year stayed the transfer [of Md Sharif Uddin] and directed the authorities concerned to allow him to continue in the office for the next two weeks.
Based on the lawyer-certificate issued by Md Mazharul Haque, Dainik Purbokone, a Bangla daily in Chattogram, published a report on July 31.
Today, the bench of Justice M Enayetur Rahim found another writ petition had been moved before it seeking similar order so that Md Sharif Uddin's transfer order is halted.
Md Shahidul Islam Liton, who said he is a human rights activist in Cox's Bazar, filed the writ petition.
Examining the petition, Justice Enayetur said his court on June 30 rejected a similar writ petition, but a report was published on the Dainik Purbokone on July 31 saying that the bench on July 29 stayed the transfer of ACC official Sharif Uddin, which is false.
The bench called ACC counsel Khurshid Alam Khan through a deputy attorney general and asked the lawyer (Khurshid) to issue a rejoinder to Dainik Purbokone regarding the report and to conduct an investigation into the incident.
Writ petitioner Shahidul Islam Liton's lawyer Ashanur Rahman prayed to the court to reject the writ petition considering that it was not moved properly. The HC bench later removed the petition from its cause list.
No lawyer named Md Mazharul Haque could be found in the members' list of the Supreme Court Bar Association.
ACC lawyer Khurshid Alam Khan told The Daily Star that he has already talked to the Dainik Purbokone office and asked it to publish a rejoinder offering unconditional apology for publishing the false report.
Deputy Attorney Generals Samarendranath Biswas and Bipul Bagmar represented the state during the virtual proceedings today.
Contacted, the lawyers and deputy attorney generals said they do not know Md Mazharul Haque as a lawyer of the Supreme Court.
