Death for Negligence: HC rule on govt, Max Hospital
The High Court yesterday issued a rule asking the government and doctors concerned of Max Hospital in Chittagong to explain in four weeks why they should not be directed to give appropriate compensation to the family of Rafida Khan Raifa.
Raifa, three-year-old daughter of journalist Mohammad Rubel Khan, died on June 29 at Max Hospital in Chittagong allegedly due to doctors' negligence and wrong treatment, after she had been admitted there for throat pain.
Yesterday, the HC in the rule asked the respondents to show causes as to why legal action should not be taken against the doctors whose negligence led to Raifa's death.
The health secretary, additional health secretary (hospital), president of Bangladesh Medical and Dental Council, Max Hospital's doctors Bidhan Roy Chowdhury, Debashish Sengupta and Shubhra Dev have been made respondents to the rule.
The court also asked the government to explain why it should not be ordered to set a guideline for ascertaining compensation for injuries and deaths caused by medical negligence and wrong treatment.
The HC bench of Justice Syed Muhammad Dastagir Husain and Justice Md Iqbal Kabir issued the rule following a writ petition filed by Raifa's father seeking necessary guidelines and directives for the compensation.
A government investigation, led by the Chittagong civil surgeon, has reportedly found doctors' negligence during treatment that led to the girl's death.
Barrister Mohammad Enam appeared for the writ petitioner while Deputy Attorney General Amit Talukder represented the government.
