To seek permission for treatment abroad, Khaleda has to return to jail: Law minister
Law Minister Anisul Huq today said BNP Chairperson Khaleda Zia will have to return to jail if she wants to seek permission to go abroad for treatment.
Khaleda Zia had applied for her release from prison under section 401 of the Code of Criminal Procedure (CrPC) but she had not applied for permission to go abroad for treatment, he said.
He made the comment while exchanging views with reporters at a programme organised by Law Reporters Forum at a hotel in Dhaka.
Minister Anisul Huq said the application for Khaleda Zia's release from jail has already been disposed of.
To file a fresh application for treatment abroad, she has to return to jail first as she is a convicted criminal, he added.
Earlier in May this year, the law ministry refused to allow BNP Chairperson Khaleda Zia to go abroad for treatment.
The government released Khaleda Zia on March 25 last year after suspending her jail sentence as per section 401 (1) of the Criminal Code of Procedure (CrPC).
Section 401(1) of the CrPC says, "When any person has been sentenced to punishment for an offence, the Government may at any time without conditions or upon any conditions which the person sentenced accepts, suspend the execution of his/her sentence or remit the whole or any part of the punishment to which he/she has been sentenced".
Later on, the suspension of her jail sentence was extended twice and the government issued separate notifications to this effect.
The notification said Khaleda will receive treatment at her home and cannot go abroad during this period.
