The High Court today directed the Police Bureau of Investigation to conduct a fresh investigation into the allegation against BGB member Md Akhtaruzzaman of raping a 15-year-old girl from Nilphamari who sought justice directly appearing before the HC on June 15 this year.
The superintendent of PBI in Nilphamari has been ordered to conduct the investigation without any influence and interference from any vested quarter and submit the investigation report to the HC within 60 days.
Delivering the verdict on an appeal filed by the victim, the HC ordered the inspector general of police to take departmental action against the investigation officer of the rape case, Md Shahidur Rahman, also sub-inspector of Saidpur Police Station of Nilphamari, for his negligence in the investigation -- because of which the tribunal of the district had exempted the accused from the rape charges.
Also today, the HC bench of Justice Jahangir Hossain Selim and Justice Md Bashir Ullah ordered the authorities of National Institute of Mental Health in Dhaka to provide treatment to the alleged rape victim who is now traumatised, Deputy Attorney General Sarwar Hossain Bappi told The Daily Star.
Buddrun Nahar, a panel lawyer of the Supreme Court Legal Aid Committee, and Supreme Court lawyer Mohammad Shishir Manir appeared on behalf of the victim and moved the appeal before the HC saying there is evidence of rape in the medical report, and therefore, the accused cannot be exempted and tribunal order might be scrapped.
Deputy Attorney General Sarwar Hossain Bappi represented the state during hearing of the matter.
Lawyer Buddrun Nahar on June 26 submitted the appeal to the HC bench led by Justice Jahangir Hossain Selim, seeking cancellation of the trial court order and punishment for the accused BGB member.
On June 15, in an instance that left the judges and lawyers present in the courtroom astonished, the teenager along with her mother directly appeared before the HC bench and sought justice.
