No bar to demolish part of cold storage on Karnaphuli
The Supreme Court (SC) yesterday upheld a High Court order that cleared the way for Chattogram district administration to demolish a part of the Karnaphuli cold storage building, illegally built on the bank of the river.
A six-member bench of the apex court, headed by Chief Justice Syed Mahmud Hossain passed the order, dismissing an appeal filed by Karnaphuli Ship Builders Ltd -- owner of the cold storage -- challenging the HC order.
There is no bar on the administration to knock down the illegal part of the building following the apex court order, Advocate Manzill Murshid, lawyer for the administration, told reporters.
Following a petition filed by the administration, the HC on September 3 stayed a lower court order that on April 16 issued a status quo on the demolition. Then, Karnaphuli Ship Builders filed an appeal with the SC, challenging the order.
On August 16, 2016, following a writ petition filed by Human Rights and Peace for Bangladesh, the HC had directed the authorities concerned to remove 2,181 structures illegally built on the Karnaphuli river.
Barrister M Amir-Ul Islam, Advocate AM Aminuddin and Barrister Sheikh Fazle Noor Taposh appeared for Karnaphuli Ship Builders Ltd.
