Forgery gets murder accused's bail axed
The High Court yesterday cancelled bail of a murder accused from Joypurhat for providing forged documents and fabricated information about charge sheet and his surrender in his bail petition.
Cancelling the bail of Azad Hossain, the court also ordered the Supreme Court's registrar general to file a criminal case against those persons who are responsible for the forgery, Deputy Attorney General Shaikh AKM Moniruzzaman Kabir told The Daily Star.
The DAG said the bench of Justice M Enayetur Rahim and Justice Amir Hossain passed the order after he placed the forged documents and fabricated information before it recently.
He said one Arafat Hossain of Joypurhat municipality was hacked to death on August 4, 2014 and later his mother Jobeda Khatun filed a case against Azad and nine others in connection with the killing.
Following the bail petition filed by Azad, the HC bench granted bail to him (Azad) in the case on February 29 this year, he said.
DAG Moniruzzaman said he recently found that Azad in his bail petition said that he surrendered to the trial court on April 27, 2015, though police arrested him on the same day in the case. The bail petition also stated that the charge sheet was yet to be submitted to the lower court in the case though police submitted the charge sheet against seven, including Azad, on May 31 last year, he added. He said a forged copy of the first information report was also submitted along with the bail petition of Azad.
The DAG said he proved the anomalies after he received the original case documents from the Joypurhat court. The DAG also said Azad's lawyer and those people who supplied the documents are also responsible for the forgery.
Azad's lawyer Pradip Kumar Sarkar told The Daily Star that he signed and moved the bail petition on the basis of documents supplied by one Azijar from Joypurhat on behalf of his client. Azijar could not be reached for his comments on this issue despite several attempts over his cell phone.
