A journalist has been arrested in Khulna in a case filed under the Digital Security Act for publishing “false” information on the number of votes cast in a constituency during Sunday's polls.

Hedayet Hossain Mollah, local correspondent of the Dhaka Tribune, was arrested yesterday, a day after the case was filed against two reporters, including him, with Batiaghata Police Station in the district.

The other accused is Rashidul Islam, staff reporter of the daily Manab Zamin, reports our correspondent in Khulna.

According to the initial announcement of the election results, the number of votes cast in Khulna-1 was higher than the total number of voters in the constituency. As the matter was brought to the returning officer's attention, he said it was a mistake and later came up with a correction, said local journalists.

By the time the correction could be made, the two media outlets ran reports saying the number of votes cast was around 22,000 higher than the actual number of voters, they said.

Documents provided by the returning officer's office showed 45,000 of the 2,59,420 voters did not cast their ballots.

Batiaghata Upazila Nirbahi Officer Debashish Chowdhury, also the assistant returning officer, filed the case against the two journalists.

The case statement said the accused published false, fabricated and provocative information on the voting with the use of electronic devices, including laptops, which might confuse people and create a chaotic situation.

Such activities made the “fair election” questionable, the statement said.

Mahabubur Rahman, officer-in-charge of Batiaghata Police Station, told The Daily Star that they arrested Hedayet near Gallamary Bridge in connection with the case.

However, several witnesses said the journalist was picked up near Picture Palace intersection in the city when he was returning home from the Khulna Press Club.

Hedayet's wife Sayida Laila Akhter told this newspaper that she called her husband over the phone but another man picked it up and introduced himself as the OC of the police station.

“Last night, the returning officer had requested my husband to apologise for the news. Otherwise, he said my husband would face action,” she said.

Despite repeated attempts, the RO could not be reached over the phone for comments.

Handcuffed, Hedayet was produced before a district court which sent him to jail.

Meanwhile, a former deputy secretary of the Election Commission has been picked up by detectives in the city's Agargaon area for “leaking information on the election”.

Shamsul Alam was allegedly collecting election results submitted to the commission from across the country and sending those to “others”, said police and EC sources.

He was picked up near the Nirbachan Commission office on Monday night, they said.

GG Biswas, officer-in-charge of Sher-e-Bangla Nagar Police Station, said the official was kept at the DB office on Mintoo Road.

Abdul Baten, additional commissioner (detectives) of the Dhaka Metropolitan Police, said they picked up Shamsul for interrogation. 

In the first parliament 45 years ago, none of the parties was recognised as official opposition due to their poor strength in the House.

The resounding victory of ruling Awami League-led alliance in Sunday's polls has diminished the scope for emergence of an official opposition in the new parliament.

The AL-led alliance together grabbed 288 seats out of 298 with the ruling party alone bagging 259 seats. The BNP-led alliance managed to secure only seven seats. [Election to Gaibandha-3 was rescheduled to January 27 following the death of a candidate and re-polling will take place in three centres in Brahmanbaria-2 on January 9.]

Against this backdrop, Jatiya Party may sit on the opposition bench in the new parliament to be formed with MPs-elect swearing in tomorrow.

The JP, a key component of the AL-led grand electoral alliance, emerged as the second largest party by obtaining 20 seats.

It needs at least five more to get official recognition as the opposition, according to the verbal directive given by Bangabandhu Sheikh Mujibur Rahman during a debate in the first parliament on April 12, 1973.

In the first parliamentary election held in 1973, the AL won 293 seats. The opposition parties -- Jatiya Samajtantrik Dal, Bangladesh Jatiya League, National Awami Party and others obtained only seven seats.

They extended their support to Jatiya League leader Ataur Rahman Khan and demanded that he be recognised as the leader of the   opposition.   

During the debate over recognition as opposition, Bangabandhu said a party could not be recognised as opposition if it did not have at least 25 MPs.

If any group has less than 25 MPs and at least 10 MPs, it can be termed a parliamentary group, not a parliamentary party, said Bangabandhu.

"The speech delivered by Bangabandhu Sheikh Mujibur Rahman is the only directive," wrote Khandaker Abdul Haq in his book "Parliamentary Practice and Procedure" published by the Jatiya Sangsad Secretariat in 2001.

"His directive has been derived from experiences of the Pakistan National Assembly and East Pakistan Provincial Assembly and it is consistent with the parliamentary culture of India and this sub-continent," wrote Haq, who was a senior official at the Parliament Secretariat.

If Bangabandhu's directive is taken into consideration, JP would need five more seats to qualify to become the opposition party in the new parliament. If JP is not the official opposition, none of its MPs could be the leader of the opposition.

The JP became the main opposition in the current parliament formed through the 2014 election, which the BNP-led alliance boycotted. It won 34 seats and its senior leader Raushan Ershad was recognised as the leader of the opposition with a status of a minister. Three JP MPs were also made ministers.

Their dual role has been criticised. The party could not play its due role as the main opposition in parliament in the last five years.

JP Secretary General Mashiur Rahman Ranga yesterday said his party would hold a joint meeting of the party's presidium members and MPs-elect today to decide whether it would join the government or sit on the opposition bench.

"We will also discuss it with the grand alliance," he said at a discussion at the party's Banani office.

Jatiya Party Chairman HM Ershad, who declared himself the leader of the opposition in parliament, now wants the status of a deputy prime minister. But such a post does not exist.

The leader of the opposition now enjoys the status of a minister. If it is to be given the deputy prime minister's status, the constitution first needs to be amended to create the post.

“I will request the new government to formulate a law to upgrade the post of the opposition leader to deputy prime minister. I will place the proposal in parliament. I will also speak to the Speaker [of parliament] in this regard,” he said, while talking to reporters after taking oath as an MP at the Jatiya Sangsad Bhaban.

Speaker Shirin Sharmin Chaudhury administered the oath at her office in parliament yesterday.

Ershad has been elected MP from Rangpur-3.

Twenty-two JP MPs-elect, except Ershad, took the oath as lawmakers of the 11th parliament on January 3. The JP chief could not take the oath due to illness.

After taking the oath yesterday, Ershad went to the room designated for the leader of the opposition at the Jatiya Sangsad Bhaban.

Sitting on the chair of the opposition leader, he told reporters that he was proud of taking oath as the opposition leader.

The former military ruler said he would request the government to elect the deputy speaker from the opposition MPs.

Ershad, who grabbed the state power in March 1982 by ousting the elected government of President Justice Abdus Sattar, said he would also request the government to upgrade the post of the opposition whip.

He said he would also urge the government to appoint more opposition MPs as chiefs of different parliamentary standing committees.

“We want to play the role of a strong opposition party in parliament. We will play our role following the rules of procedure in parliament. We will not boycott the parliament like the previous opposition parties,” he said.

JP Secretary General Moshiur Rahman Ranga told reporters that Ershad would be the first male in the last 27 to act as the leader of the opposition.

Just a day after the JP Parliamentary Party decided to join the Awami League-led grand alliance government, Ershad on January 4 came up with a completely opposite decision.

The JP chairman in a statement announced that his party would be the main opposition in parliament with no representation in the new cabinet.

Ershad, who was forced to step down from the president post following a mass movement in December 1990, also announced that he would act as the leader of the opposition and his younger brother and JP co-chairman GM Quader would be the deputy leader of the opposition.

Talking to this newspaper, several JP lawmakers termed Ershad's decision funny and arbitrary.

Earlier on January 3, JP Parliamentary Party unanimously decided that since JP contested the election under the banner of the AL-led grand alliance, they would join the government.

Sources at the Parliament Secretariat said Speaker Shirin Sharmin has yet to take measures to recognise Ershad as the opposition leader.

Ershad's wife, Raushan Ershad, was the leader of the opposition in the 10th parliament.

In the December 30 polls, the AL-led grand alliance secured 288 seats. JP, a key component of the alliance, bagged 22.

The BNP-led Jatiya Oikyafront managed to win only seven seats, while independent candidates got three.

Previous parliamentary opposition Jatiya Party (JP) today expressed dissatisfaction over the outcome of the 11th parliamentary election held Sunday.

Reflecting on it today, the party's Secretary General Mashiur Rahman Ranga said: “The party expected to win more than 22 seats in the election”.

However, he said, “Our party is now stronger than before”.

“We will decide tomorrow whether we will remain as an opposition in the parliament,” he said; adding “the joint meeting will be held with the newly elected lawmakers and standing committee members at 11:00am tomorrow”.

HOW WAS THE ELECTION?

Voting for the 11th parliamentary election ended peacefully in Dhaka; but was tainted with violence elsewhere across the country and cost the lives of at least 19 people.

Reports of casualties came in from Cumilla, Chattogram, Sylhet, Rajshahi, Dinajpur, Rangamati, Cox’s Bazar, Bogura, Noakhali, Narsingdi and Gazipur.

Allegations of vote rigging, election clashes, intimidation and irregularities came in from several other constituencies and capital Dhaka city.

Also, the election saw opposition candidates boycotting elections in at least 43 constituencies; 42 of who were Jatiya Oikyafront runners.

Law Minister Anisul Huq yesterday said Jatiya Oikyafront's demand for holding a re-election is unconstitutional and “very illogical”.

“Jatiya Oikyafront's demand is an expression of disrespect to the people,” the minister said while talking to reporters after attending a programme, organised to accord a farewell to Zafrul Hasan, outgoing director of National Legal Aid Services Organization (NLASO), at its Bailey Road office.

The law minister said Oikyafront has no right to dishonour the people, who have cast their votes in the December 30 general election.

Replying to a question, Anisul Huq also said, Hefajat-e-Islam Chief Ahmad Shafi's comment about girls' education is opposing to the positive development of the country.

“Last year, Prime Minister Sheikh Hasina recognised Dawra degree of Qawmi madrasa as equivalent to master's degree, which was a positive step. Allama Shafi is a senior person. With due respect to him, I want to say that his comment will be opposite to the country's positive development. It will be better if such a statement is retracted,” the law minister said.

“The government will not bring any change in running the country or its [government] policies. The Sheikh Hasina-led government is committed to upholding the rights of women. The commitment will be strengthened and the country will move forward; and it's the government's policy and belief,” he said.

Acting director of NLASO Bikash Kumar Saha presided over the function, where Law Secretary ASSM Zahirul Haque Dulal and its Joint Secretary Golam Sarwar also spoke.
