HC starts delivering judgement
The High Court (HC) yesterday started delivering the judgement of a writ petition challenging the legality the Contempt of Court Ordinance 2008.
The HC bench of Justice ABM Khairul Haque and Justice Md Abu Tariq will continue passing the verdict today.
Supreme Court lawyers Shamsul Huq and Tajul Islam filed the writ as a public interest litigation with the HC challenging the legality of the ordinance.
Following the petition, the HC on June 7 issued a rule upon the government to explain why some provisions of the Contempt of Court Ordinance 2008 should not be declared beyond the powers of the constitution and void.
During the hearing of a separate case, the HC on July 6 also issued a suo moto rule upon the government, asking it to explain within one week why the Contempt of Court Ordinance 2008 should not be declared unconstitutional.
The court also appointed five legal experts as amicus curiae (friend of the court) for legal interpretations in the case.
The amicus curiae are advocate Mahmudul Islam, Barrister M Amir-Ul Islam, Barrister Rafique-ul Huq, Barrister Ajmalul Hossain and Dr Shahdeen Malik.
