Send GD to Dhaka court
The High Court yesterday directed the chief judicial magistrate of Narayanganj to immediately transfer the general diary lodged for public humiliation of headmaster Shyamal Kanti Bhakta to the Chief Metropolitan Magistrate's Court, Dhaka.
The HC also ordered the authorities concerned to submit to the CMM's court the judicial probe report and other relevant documents on the incident.
The CMM's court has been directed to take the next course of action in accordance with the law.
The HC bench of Justice Moyeenul Islam Chowdhury and Justice JBM Hassan passed the order after going through the judicial probe report.
It disposed of the suomoto rule it issued on May 18 last year asking the government to explain why it should not be directed to take necessary legal action against Jatiya Party lawmaker AKM Salim Osman and others involved in humiliating the teacher.
While hearing the rule yesterday, the HC said the duty of law enforcers is to exercise the law impartially and without discrimination.
Nobody can take the law into own hands, the court said, adding that nobody is above the law and everybody is subject to the law and it is the spirit of rule of law.
MK Rahman, a Supreme Court lawyer who placed different newspaper reports on the incident before the court for an order on May 18 last year, yesterday told reporters that the judicial probe has not found any authentication of the allegation against Shyamal of making derogatory comments about religion in May last year.
The judicial probe has found it true that Shyamal was beaten up and forced to squat holding his ears, he said.
The CMM's court will now take legal steps based on the GD, judicial probe report and other relevant documents concerning the humiliation of the Narayanganj schoolteacher, he added.
In the second week of May last year, a video clip went viral in the social media, showing how the headmaster of Piyar Sattar Latif High School in Narayanganj was humiliated and forced to squat holding his ears in presence of Salim Osman.
