Concern over appointment at law ministry from admin cadre
Bangladesh Judicial Service Association yesterday expressed its deep concern over appointment of an additional secretary to the law ministry from the administrative cadre, says a press release.
On Monday, the government appointed Hedayetullah Al-Mamun as the additional secretary to the law, justice and parliamentary affairs ministry. He was serving the establishment ministry as the additional secretary.
The release signed by Office Secretary of the association KM Imrul Kayes said at an emergency meeting, members grumbled at the appointment of the administrative officer suppressing provisions of the Supreme Court (SC).
The appointment was contrary to the principles, ideals and objectives of the separation of the judiciary as well as the judgement of the Masdar Hossain Case.
It was also similar to the violation and the contempt of court that was related to the judgement of a writ passed by the High Court bearing number 11736/06 and judgement of a leave to appeal passed by the Appellate Division of the SC.
Moreover, before appointment of the secretary, the establishment ministry did not take any advice from the court or from the law ministry that the constitution regulates.
The members of the association said the establishment ministry has no jurisdiction to make such appointment. In the history of the law ministry, such unprecedented appointment would have an ill attempt to control and damage the independence of separation of the judiciary.
They urged the government to cancel such unconstitutional and unexpected appointment of an additional secretary (administrative cadre) from the establishment ministry and to appoint a judicial official to the law ministry.
