HC stay on BWSA ad-hoc body
A High Court bench has issued a stay order on the ad-hoc committee of Bangladesh Women's Sports Association (BSWA) for one month and served a show cause notice on the National Sports Council as to why the respondents should not be directed to allow the elected executive committee of the association to assume its office and continue functioning till the completion of tenure.
The bench, consisting of Justice Mirza Hussain Haider and Justice Muhammad Khurshid Alam Sarkar, passed the order in response to a writ petition filed by Mahfuza Akhter Kiron, former general secretary of the dissolved elected executive committee.
The respondents have been asked to reply within three weeks of the date of issuance of the order.
The NSC, the country's sports regulatory body, dissolved the elected executive committee of BSWA on November 3, 2011 and formed an ad-hoc committee, which also failed to become functional and later on March 15 this year, the NSC formed a seven-member ad-hoc committee dissolving the previous one and asked them to hold the election of BSWA immediately.
“The implication of this stay order means that there is no ad-hoc committee now in regards to law and legally elected persons of BSWF are the only body in office and entitled to run the affairs of the federation till further notice is passed,” said barrister Masood R Sobhan in his statement provided by Kiron.
NSC law official Kabirul Islam said that they are yet to receive a copy of the court order, but they are trying to get hold it.
“If a vacuum is created after the court order, then the elected committee might be reinstated to make the organisation functional but after consultation with senior lawyers we will pursue the matter in court,” said Islam.
