Petition seeks SC stay on HC verdict allowing lawyer to practice without enrolment certificate
Two Supreme Court lawyers today filed a petition with the Appellate Division of the Supreme Court seeking a stay on a High Court verdict allowing a lawyer to practice in court without any enrolment certificate.
The HC in its verdict had upheld the Bangladesh Bar Council's decision to allow lawyer Jumman Siddique to practice law although he failed the enrolment test.
Lawyers Syed Sayedul Haque Suman and Ishrat Hasan submitted the petition through their lawyer Aneek R Haque.
The petition also challenged the contempt of court rule issued by the HC against them for allegedly posting derogatory comments about the judiciary on Facebook, and sought stay on the HC order on November 8 that summoned the two lawyers to appear before HC in person on November 16 to give their explanation on this issue and imposed a fine of Tk 100 on each of them.
Lawyer Aneek R Haque told The Daily Star that the apex court chamber judge may hold a hearing on the stay petition tomorrow.
On October 31 last year, a gazette notification was issued by the Bangladesh Bar Council that allowed Jumman Siddique to practice law although he failed the enrolment test.
The HC said in its verdict that since Jumman Siddique has a foreign degree and has experience practicing law in foreign courts, therefore, he can practice in courts concerned in Bangladesh as per the relevant law.
