SC allows independent mayor candidate Masud to contest Nalchhiti municipality polls
The Appellate Division of the Supreme Court today cleared the way for independent mayoral candidate KM Masud to contest Nalchhiti municipality election in Jhalakathi to be held on January 30.
The apex court upheld a High Court order that ordered the Election Commission to allow Masud to contest the election.
An Appellate Division bench headed by Chief Justice Syed Mahmud Hossain passed the order after hearing a petition filed by KM Masud seeking cancellation of its chamber judge's order that stayed the HC order.
Masud submitted the nomination paper to the returning officer concerned on December 31 last year for contesting as an independent mayoral candidate in Nalchhiti municipality election. The returning officer later cancelled his nomination saying that he did not provide necessary information along with the nomination paper.
Following a writ petition filed by Masud, the HC on January 13 stayed the returning officer's decision and asked the returning officer to allocate an election symbol to him and to allow him to contest Nalchhiti municipality election.
The state on January 19 moved a petition before the Appellate Division's chamber judge court seeking stay on the HC order. The chamber judge stayed the HC directive for eight weeks.
Masud then filed a petition with the full bench of the Appellate Division against the chamber's stay order.
