‘Declaring Amin Uddin SCBA president without election against charter’
The pro-BNP faction of Supreme Court Bar Association (SCBA) yesterday protested the declaration of Attorney General AM Amin Uddin, a pro-Awami League lawyer, as the new SCBA president without election.
The announcement from SCBA Vice President Muhammad Shafique Ullah on May 4 is contradictory to its constitution, said its Secretary Md Ruhul Quddus Kazal, also leader of its pro-BNP group.
He was speaking at a press conference organised by the faction under the banner of SCBA in its auditorium.
The post of SCBA president was left vacant after its newly-elected President Abdul Matin Khasru died of Covid-19 on April 14.
The SCBA secretary told the press conference that the vacant post must be filled via election as per article-16 of its constitution.
The article-16 reads, "In the case of a casual vacancy occurring on account of the removal, resignation or death of any office bearer or other member, the vacancy shall be filled within a month by election in a Special General Meeting of the Association to be held for the purpose and the manner of this election shall be decided by the meeting itself."
Ruhul Quddus said the special general meeting, which was scheduled to be held on May 4, has been postponed without any discussion and decision.
Six BNP-backed office bearers of SCBA -- including Ruhul -- attended the press conference.
Meanwhile, AM Amin Uddin told this correspondent on Tuesday night that there is no legal bar for him to discharge the responsibility of SCBA president as the executive committee (led by Muhammad Shafique Ullah) has issued a resolution declaring him elected.
"I will start discharging responsibility as the SCBA president later on because the regular court functions are now suspended due to the Covid-19 pandemic. I will take necessary decisions after talking to relevant persons concerned of the SCBA," he added.
A special general meeting of the SCBA ended on Tuesday amid chaos and scuffle among lawyers and ignorance of health guidelines.
The incident occurred after ruling Awami League lawyers led by SCBA Vice President Muhammad Shafique Ullah proposed the name of outgoing president AM Amin Uddin as its new president.
Shafique Ullah also declared AM Amin Uddin elected president of the prime bar association for rest of the period of 2021-2022 amid the chaos and scuffle.
Later in the day, the SCBA faction led by Shafique issued a resolution saying that all the members of the bar orally supported Amin Uddin as the new president as name of any other lawyers was proposed in the meeting for the post of SCBA president.
