HC judge embarrassed on writ petition
One of a two-member High Court (HC) bench yesterday felt embarrassed to pass an order on a writ petition filed by BNP leaders Barrister Rafiqul Islam Miah and Shah Moazzem Hossain challenging the legality of a police notice that asked them to appear at a police station.
The bench of Justice Mamnoon Rahman and Justice Syeda Afsar Jahan sent the petition to the chief justice.
The BNP leaders filed the writ petition with the HC Sunday challenging the legality of the notice issued by the Paltan police asking them to appear at the police station today in connection with a charge against them of threatening Prime Minister Sheikh Hasina.
While talking to The Daily Star, the lawyers for both the petitioners and the state side, said Justice Syeda Afsar Jahan felt embarrassed to pass an order regarding the petition.
But they could not say the reasons behind the judge's feeling embarrassed, as the judges did not disclose it.
Additional Attorney General Murad Reza said Rafiqul Islam Miah and Shah Moazzem Hossain have to appear at the police station, as the HC has not stayed the notice.
Meanwhile, Barrister Badruddoza Badal, a lawyer for the petitioners, said the petitioners need not appear at the police station, since the police have become a sub-judice matter.
After conclusion of hearing on the petition, senior judge of the bench Justice Mamnoon Rahman told the lawyers that the two judges of the bench have some differences in opinions on the matter.
