CID again fails to submit report on further probe into Kibria killing

The Sylhet Divisional Speedy Trial Tribunal yesterday asked the CID to submit the report on further investigation on January 4, 2010 on the killing of former finance minister SAMS Kibria and others.
The date was refixed following a petition for time extension.
Earlier on November 15, the CID was asked to file the report by December 15. With deferment of the date yesterday, the CID has failed to file the report in over two and a half years.
The then investigation officer (IO) of the case, senior ASP of CID Munshi Atiqur Rahman, through a petition, informed the Sylhet Divisional Speedy Trial Tribunal on March 7, 2007 that a further probe into the case was necessary. As Munshi went into retirement a few months later, CID's ASP Md Rafiqul Islam was given the task.
Rafiqul, who took the 5 Huji men on remand in December last year, said on occasions that Huji chief Mufti Abdul Hannan, his brother Mofizur Rahman alias Muhibullah alias Ovi, Sharif Shahedul Alam Bipul, Delwar Hossain Ripon, Badrul Alam Mizan, Hafez Nayeem and others would be made accused in the supplementary charge sheet soon. But, till date there was no step in that direction, sources said.
Former finance minister SAMS Kibria, his nephew advocate Shah Manzurul Huda, local AL leaders--Abdur Rahim, Abul Hossain and Siddique Ali were killed in a grenade attack at a public meeting at Baidderbazar of Habiganj Sadar upazila in the night following January 27 of 2005. ASP Munshi Atique filed the charge sheet in the case on March 20 the same year against 10 people.
But the complainant, district AL organising secretary Advocate Abdul Majid Khan (now AL lawmaker from Habiganj), filed a Naraji petition against the charge sheet. The magistrate rejected it and fixed May 10 of the same year for hearing. However, before the start of hearing, the case was shifted to the Speedy Trial Tribunal in Sylhet.
The then tribunal judge Biplob Goswami too rejected the complainant's Naraji petition in May 2006. Then the complainant went to the high court (HC) which stayed the case proceedings.
However, the HC order staying the trial process of the two cases--one under explosives act and the other for killing -- was vacated in December last year.
Chief of Zia Gobeshona Parishad and vice-president of Habiganj district BNP Abdul Quaiyum was made the principal accused in the charge sheet. The other accused were Zainal Abedin, Jamir Ali, Momin Ali, Tajul Islam, Shahed Ali, Chhondu Miah, Selim Ahmed, Enayet Ali and Muhibur Rahman. Among them, eight including Abdul Quaiyum were released on bail after more than three years in the jail hajat.
