No arrest warrant needed for cognisable offences, Dhaka court observes

A Dhaka court today said arrest warrants are not needed for cases filed over cognisable offences after a petition was filed before it by a Dhaka University student seeking warrants for former Ducu-VP Nurul Haque Nur and five others.
Dhaka Metropolitan Magistrate Begum Mahmuda Akter passed the order after the female student's lawyer filed the petition seeking issuance of arrest warrants against Nur and five leaders of Bangladesh Chhatra Odhikar Parishad, in a case filed under the Women and Children Repression and Prevention Act.
Advocate Hemayet Uddin Khan Hiron, a lawyer of the complainant, confirmed the development to The Daily Star in this regard.
"It is a sensitive case, but police are yet to arrest any of the accused till now, although the scenario of other cases like the MC College rape case or Savar's schoolgirl murder case are different," said Hiron.
"If the accused in this case are not arrested, there is much possibility for the investigation into the case to be interrupted."
"The complainant is concerned that she may be deprived of justice as no accused has been arrested yet for unknown reasons," the complainant's lawyer added.
The case was filed with Lalbagh Police Station on September 20.
The five other accused are Bangladesh Chhatra Odhikar Parishad's suspended convener Hasan Al Mamun, joint conveners Nazmul Hasan Sohag and Saiful Islam, its DU unit vice-president Nazmul Huda and activist Abdullah Hil Baki.
In the complaint, the victim stated that Hasan Al Mamun raped her at his Lalbagh residence on January 3.
She also claimed that she had a love affair with Mamun and that he had promised to marry her, but he did not do so.
Nur in the name of arbitration over the matter had "threatened the complainant of character assassination through posts on social media," the case statement said.
Besides, two more cases were also filed against the six under the Women and Children Repression and Prevention Act and the Digital Security Act by the same victim.
