HC upholds death penalty of three
The High Court yesterday upheld the death penalty of three convicts in Abdur Razzaq Fakir murder case of Mymensingh.
The HC, however, commuted death penalty of another convict to life imprisonment in the same case. Abdur Razzaq Fakir (32), a poultry trader of Taltola village at Madhupur Bazar in Tarakanda upazia was killed in October 2008.
Yesterday, the HC bench of a Justice Shahidul Karim and Justice Md Akhtaruzzaman came up with the verdict after hearing death reference (trial court's documents) of the case and appeals filed by the convicts challenging the trial court verdict.
The convicts, whose death sentences have been upheld by the HC, are Mir Jahan, Emdadul Haque, and Anisur Rahman. The convict, whose death sentence has been commuted, is Ziaul Haque. The grounds on which the HC delivered the verdict could not be known as its full text was not released yet.
Lawyers Fazlul Huq Khan Farid and SM Shahjahan appeared for the convicts while Deputy Attorney General Bashir Ahmed represented the state.
The court of additional district and sessions judge of Mymensingh on May 4, 2015 sentenced all the four to death in Abdur Razzak Fakir murder case.
According to the case statement, the convicts swooped on Abdur Razzaq Fakir while he was going to Mymensingh town around 8pm on October 15, 2008.
They stabbed Razzaq and took away Tk 15,000 from him. Razzaq died on the spot. Locals chased the gang and caught Mir Jahan, one of its members, while the rest managed to flee.
They later handed him over to the police. During interrogation, Jahan disclosed the names of three other gang members who were later arrested.
Victim's elder brother Hazrat Ali Fakir filed a murder case with Tarakanda Police Station the following day.
