The families of two teenagers killed in Mohammadpur during a clash of Awami League factions ahead of the general election have been robbed of justice.

The family members of one of the victims said police submitted the final report in the case without talking to them. The report mentioned no clash even though it was widely covered by the media at that time. It termed the incident an “accident”.

Councillor Tarequzzaman Rajib of ward-33 also threatened the father of one of the victims not to file a murder case, they said. 

A case was filed after the November 10, 2018, incident and the father of one of the teens was made the plaintiff.  

The father maintains he did not file the case and that the signature on the case document could not be his since he is illiterate. He said Councillor Rajib put a gun to his head and told him to do as he said after the incident. 

The families opened up to this paper only after Rajib was arrested this week. 

On the morning of November 10, 2018, a procession of vehicles, largely comprised of flatbeds, with supporters of AL leader Sadek Khan was going towards the AL Dhanmondi office to buy nomination paper for Sadek’s candidacy in the polls.  

Mohammad Sujon, 19, and Arif Hossain, 14, were on one of the pickup trucks when the procession was attacked allegedly by the men of rival AL leader and then lawmaker Jahangir Kabir Nanak.  

During the melee Sujon and Arif fell off the vehicle and the driver, trying to avoid the brick chunks being hurled at the pickup, reversed and ran the two over, according to case documents, news reports, witness accounts, and statements of the families.  

Sujan and Arif died in hospital. 

Arif’s father Faruk Hossain was taken to a community centre in Mohammadpur when he was on his way to the hospital. He was confined there for 12 hours by Rajib’s men, Faruk told The Daily Star.  

Late at night, Rajib, reportedly Nanak’s ally, at the community centre told Faruk to go to the police station to talk about getting the body of his son. 

Faruk then went to the police station, gave his details, and told the officials there what he knew about the incident. He had no idea that police were filing a case making him the plaintiff. The police officials there asked him to identify the body at the Suhrawardy hospital, Faruk said.  

On his way to the hospital from the police station, two men stopped him near Shia Masjid and took him to Rajib’s home.  

Rajib told him at gunpoint to do as he said regarding the matter, Faruk told The Daily Star.  

“You wouldn’t get anything if you file a murder case. Instead, you will be harassed and face the same consequences as your son. You are from Lalmonhon of Bhola and so am I. Do what I say. You will get a good compensation,” Faruk quoted Rajib as saying. 

Faruk eventually identified his son’s body the next day.

Faruk said, “After the incident, I thought it was police who were the plaintiff in the case.

“This is my NID, sir. See, I can’t sign,” Faruk showed his NID to this correspondent which had his thumb print. 

Faruk said not a single police officer talked to him about the investigation since then. 

Sujon’s uncle Md Riaz told The Daily Star last night that the police never talked to them either.

He said councillor Rajib had promised them compensation and jobs for family members but he never delivered.

Sujon’s family did not know that the final report was submitted. They heard it first from The Daily Star correspondent.

After “investigating” the case for 11 months, police submitted the final report terming the incident an “accident”.

Police had arrested convener of Jubo League’s Adabar Thana unit Arifur Rahman Tuhin in connection with leading the attack but in the final report police said they found no evidence of Tuhin’s involvement.  

Rajib, on behalf of then MP Nanak, had given Arif’s family Tk 30,000 and Sujon’s family Tk 25,000 as burial cost. 

After the incident, AL General Secretary Obaidul Quader said the prime minister directed the authorities concerned to submit a probe report over the incident within two days. 

Whoever is found involved would be given exemplary punishment, he had said, adding that the prime minister wanted to know “who destroyed the peaceful election environment”. 

Sub-Inspector Mukul Ranjan of Mohammadpur police station, investigation officer (IO) of the case, said they submitted the final report of the case in the first week of this month as they could not find any evidence or witnesses. 

Police also could not identify the pickup truck and its driver. 

In the final report, police said the two factions of the ruling party came “face to face” near Mohammadi Homes Ltd on November 10 when the unidentified driver reversed in a hurry and could not see what was behind him. This led to the two getting run over.  

The SI in his investigation found no evidence of the clash. He only said the two faction came “face to face”. The media, however, had extensive coverage of the incident.  

They reported that the attackers, armed with hammers, sharp weapons and brick chunks, swooped on the procession of vehicles.  

The IO said said Faruk did not know what had actually happened and had “filed the case” based on hearsay.  

Taking to this newspaper, the SI claimed that he did not find anything in CCTV footage and no local wanted to be a witness. 

Asked why the IO never contacted Faruk, the IO first claimed that he had contacted him but later said they could not reach him. 

The IO claimed that Faruk had indeed filed the case.  

At one stage of the conversation with this correspondent, the IO said he had written the final report with direction from a superior officer of Tejgaon Division Police. 

Anisur Rahman, deputy commissioner (Tejgaon division) of Dhaka Metropolitan Police, told The Daily Star that he had no knowledge about the development of the case as he joined the division only a few months ago. 

“I will have to see the documents,” he added. 

In November last year, Nanak said he had nothing to do with the attack on the procession.  

Sadek had said that he did not want to blame anyone and demanded a proper investigation. 

The Daily Star could not reach Nanak and Sadek for comments over the last few days.

We wonder whether the Chief Election Commissioner was talking about the recently concluded six-phase elections in Bangladesh or some other election in some other country when, commenting to the press he said, among other things, that he believed the last phase of the election was better than the previous one, that it was an improvement compared to the previous phases and that, barring some odd instances, the polling was held peacefully. May be he was not aware of the fact that more than 30 people were killed in the run up to the sixth phase of the election alone, bringing the tally of death in the union parishad elections to 125, not to speak of the more than thousand injured. 

When it comes to the lives of human beings, comparisons are odious. And certain things are measured in the absolute and not comparatively, election is one such thing. We are afraid the Election Commission had taken no lessons of the previous phases of the Union Parishad elections, and if it did it was either unable or unwilling to take any remedial measures. To attribute the election violence to the trend of increasing social hostility is inappropriate. Even if we were to take his contention as true, was it not for him then to resort to suitable measures to ensure that that did not spill over and affect the elections? 

Election is not confined to the day of polling. It seems that the commission was content with providing logistics only for the Election Day and remained quite unconcerned with the other aspects like submission of nomination, electioneering code violation and pre-poll violence. And by doing so it abdicated its primary responsibility.

The Jatiya Oikyafront yesterday demanded that the Election Commission immediately scrap the “farcical election” and hold a fresh one under a nonpartisan interim government.

“We reject this so-called result. At the same time, we demand fresh polls under a nonpartisan government,” Oikyafront leader Dr Kamal Hossain said at a press conference at his house in the capital.

Reading out a written statement, the eminent jurist said the news of “vote robbery” came from almost all constituencies.

Responding to a query from a journalist, BNP Secretary General Mirza Fakhrul Islam Alamgir said yesterday's election proved that free and fair polls were not possible under a partisan government.

“This also proves that our decision to boycott the parliamentary elections in 2014 was right.”

Kamal said the Oikyafront would hold a meeting today to devise its strategy. The alliance's ongoing movement “to institutionalise democracy” would continue, he added.

Apart from the Oikyafront, the Left Democratic Alliance, comprised of eight left-leaning parties, and the Ganasamhati Andolon rejected the polls and demanded a reelection.

51 BOYCOTT POLLS

As many as 49 BNP and two independent candidates boycotted polls during voting yesterday, bringing allegations of vote rigging, stuffing ballots and forcing polling agents out of centres by the ruling party men.

Other allegations include capturing of polling stations by AL men, rigging votes and barring voters from exercising their franchise.

However, the BNP didn't boycott the polls as a party.

Out of the 49 candidates, 22 are Jamaat leaders who ran on BNP's ticket.

In some districts, almost all the opposition candidates boycotted the polls. In Bagerhat, all four BNP nominees abstained from the election.

Eight out of 11 BNP candidates in Mymensingh boycotted the election. In Khulna, five out of six BNP and Oikyafront candidates opted to stay out.

Faridpur and Jhenidah saw three out of four BNP nominees boycotting the polls in each of the districts.

Jamaat leader Mia Golam Parwar, who ran on BNP's ticket in Khulna-5, first announced that he was boycotting the election over “barring voters from entering polling centres, arresting his party men and the returning officer's inaction”.

Around the same time, Shama Obayed boycotted the polls in Faridpur-2 alleging that AL men stuffed ballots in 100 out of 123 polling centres on Saturday night.

“My polling agents went to the polling centres, but they were forced to leave the centres by police and ruling party men,” the BNP nominee told The Daily Star.

Shama also said she even didn't cast her own vote in protest.

In Dhaka-1, independent candidate Salma Islam boycotted the polls around noon.

Speaking at a press conference at her house in Nababganj's Jamarkhola area, she said she stayed out of the election as it was “rigged”.

Andaleeve Rahman Partha, BNP candidate for Dhaka-17, boycotted the polls around 2:00pm citing that some 600 of his polling agents were forced out of the centres and assaulted by AL men.

JAMAAT BOYCOTTS POLLS

Meanwhile, Jamaat-e-Islami in a press statement yesterday said its leaders, who contested the polls with “sheaf of paddy”, boycotted the election.

Terming the election “a farce”, it demanded cancellation of the polls.

BNP's Mirza Abbas and his wife Afroza Abbas boycotted the polls in Dhaka-8 and 9 alleging that voters were deprived of casting their votes. The couple also refrained from exercising their franchise.

Speaking at a press conference at his Shahjahanpur home, Abbas said, “Such an election is not needed in the country in which people cannot cast their votes. We are rejecting the election result.”

Independent candidate in Kurigram-4 Imran H Sarker, also spokesperson of Ganajagaran Mancha, alleged that AL men were casting fake votes in Chilmari's Nayarhat and Astamir Char areas.

COMPLAINT LODGED WITH EC

Around noon, a BNP delegation in a written complaint informed the EC that its polling agents were obstructed from entering polling centres in 221 constituencies.

“Our polling agents are being intimidated and obstructed from entering voting stations. In some cases, they are being driven away from the polling stations or being arrested,” BNP Joint Secretary General Moazzem Hossain Alal, who led the delegation to the EC, told reporters.

He said they received the information from reliable sources. There were similar complaints from other constituencies as well, but those came from unconfirmed sources, he added.

Alal alleged that AL activists were committing irregularities with the help of law enforcers.

The BNP submitted the complaint, signed by party National Election Conducting Committee Chairman Nazrul Islam Khan, to the chief election commissioner.

Alal said voters were not being allowed to enter polling stations in many places and women were being asked to vote for AL candidates.

The party also accused the AL of stamping ballots the night before the polling day in more than half of the 299 constituencies.

“Ballots were being stamped with the help of law enforcement agencies and polling and administration officials,” the BNP said in its complaint.
