SC exempts CID from probe
The Supreme Court has exempted the Criminal Investigation Department (CID) from probing the Narayanganj seven-murder case.
The apex court passed the order yesterday after hearing two separate petitions filed by the attorney general's office on behalf of the state.
Attorney General Mahbubey Alam had moved the pleas, saying two separate agencies like the Detective Branch of Police and the CID cannot simultaneously investigate the same criminal case as per the Code of Criminal Procedure and the criminal laws.
The attorney general had prayed to the five-member bench of the Appellate Division led by Chief Justice Md Muzammel Hossain to drop the CID from the probe, saying the case proceedings would be hampered if the two agencies carry out the investigation together.
Replying to a question, Mahbubey Alam said there was no pressure from the CID or any other agency for the exemption.
The CID along with the DB was investigating the gruesome abduction and killing of seven people in Narayanganj, following a High Court order.
From the very beginning, the DB has been handling the case.
On May 5, the HC in a suo moto rule had directed the government to deploy CID into the investigation.
The HC later on July 9 in another order said that the CID would only conduct the inquiries not the investigations in the case.
Following the two HC orders, the attorney general's office filed the two separate petitions with the SC on May 11 and October 31, respectively.
Deputy Attorney General ASM Nazmul Haque said Rapid Action Battalion, Inspector General of Police and the seven-member committee formed by the public administration ministry are scheduled to submit progress reports on their investigations to the HC on November 13.
On April 27, seven people including Narayanganj city panel mayor Nazrul Islam and senior lawyer Chandan Sarkar were abducted from Siddhirganj of Narayanganj city.
Later on April 30, six bodies of them were spotted floating in the Shitalakkhya river. The seventh surfaced the next day.
