‘He seems like a made-up person’

HC summons petitioner, who challenged transfer of Ctg ACC official, to confirm his identity

The High Court yesterday summoned one Md Shahidul Islam Liton, who filed a writ petition with this court challenging the transfer of an Anti-Corruption Commission (ACC) official, Md Sharif Uddin, in Chattogram, to appear before it along with his lawyer on August 26 to be sure about his (petitioner) identity, apprehending him to be fictitious.

The petitioner and his lawyer Md Mahadi Hassan have been ordered to appear in person before the HC bench led by Justice M Enayetur Rahim at 10:30am on August 26 to explain their conducts.

"Md Shahidul Islam Liton has filed the petition claiming himself the president of Cox's Bazar's Chakoria Manobadhikar. But in the petition, it has been mentioned that his address is at Arambagh in Dhaka. He seems like a fictitious person. We want to see him in person," said Justice Enayetur Rahim.

The HC bench also directed the ACC to conduct an inquiry into the incident of fraud in its order regarding the transfer of ACC deputy assistant director Md Sharif Uddin.

Sharif, who had reportedly been conducting investigations into corruption allegations in different offices and hospitals and against influential people in the district, has been transferred on June 16.

The HC bench of Justice Enayetur and Justice Md Mostafizur Rahman on June 30 summarily rejected a petition that sought stay on his transfer.

But a lawyer named Md Mazharul Haque has issued an "advocate-certificate" saying that the HC bench of Justice Enayetur on July 29 stayed the transfer [of Sharif] and directed the authorities concerned to allow him in the office for the next two weeks.

Based on that, a few newspapers published reports on this issue.

On Tuesday, the HC bench of Justice Enayetur expressed discontent as false reports were published by the newspapers.

Yesterday, ACC lawyer Khurshid Alam Khan told the HC bench that the newspapers have published rejoinders with apology for publishing false reports based on a lawyer-certificate.

No lawyer named Md Mazharul Haque could be found in the members' list of the Supreme Court Bar Association.

Deputy attorney generals Samarendranath Biswas and Bipul Bagmar represented the state during the virtual proceedings.

Contacted, the lawyers and deputy attorney generals said they didn't know Mazharul Haque as a lawyer of the Supreme Court.
