HC restrains Evaly from selling, transferring assets

The High Court today issued an order of injunction, restraining e-commerce platform Evaly Limited from selling and transferring its assets till further order.

The bench of Justice Muhamad Khurshid Alam Sarkar passed the order after holding hearing on an application filed by Md Farhad Hossen, a consumer of Evaly.

"Pending disposal of this matter, the respondent No 1-company (Evaly) is hereby restrained from selling, transferring or otherwise dispose of the assets of the respondent No 1-company," the HC bench said in the order.    

The bench also asked the representatives of respondents to appear before it on September 30 to explain why they should not be directed to wind-up Evaly Limited, Sayed Mahsib Hossain, a lawyer for Farhad Hossen, told The Daily Star. 

The respondents are Evaly Limited, Registrar of Joint Stock of Companies and Firms, Bangladesh Financial Intelligence Unit (BFIU), Consumer Right Protection Bureau, Nagad managing director, bKash chairman, Bangladesh Competition Commission, e-CAB Association of Bangladesh, Bangladesh Association of Software and Information Services (BASIS), Bangladesh Bank and commerce secretary, the lawyer said.

In the order, the HC said the prayer for formation of a board of directors to take control of Evaly Limited's affairs, management and business will be considered after the appearance of the respondents.  

The bench fixed September 30 for passing further order on this issue.

Earlier in the day, consumer Farhad filed the application seeking HC directives for winding-up Evaly Limited and an order for distribution of net asset cash funds among the creditors on the basis of their present credit ratio.

In the application, Farhad also sought an order from the HC to direct the respondents from restraining or prohibiting Evaly from selling, transferring or otherwise disposing of the assets of the company and to form a board of directors to take control of the e-commerce entity's affairs, management and business.

Lawyer AM Masum also appeared for Farhad during hearing of the matter.
