Gulshan Club not exempted from paying income tax

Gulshan Club would have to pay income tax and submit tax return to National Board of Revenue (NBR) as a High Court bench yesterday rejected its writ petition.
The Gulshan Club authorities in Dhaka sought direction from this court on the National Board of Revenue (NBR) to exempt the club from paying income tax and filing tax return.
An HC bench of Justice Md Ashfaqul Islam and Justice SM Emdadul Hoque came up with the verdict after hearing counsels for both sides of the petition.
The Gulshan Club authorities are now liable to pay income tax and submit tax return to NBR following the HC verdict, Additional Attorney General Murad Reza told The Daily Star.
The club authorities filed the writ petition on February 12 this year claiming that this club is a limited company by guarantee without any share capital and a non-profit making organisation.
The club is not liable to pay income tax and to file tax return to NBR, the petition said.
Following the petition, the HC on April 8 direct the NBR authorities to exempt Gulshan Club from filing tax return and issued a rule upon the authorities concerned to explain why they should not be directed to declare Gulshan Club a limited company and to exempt it from filing tax return.
The SC on April 20 stayed the HC direction and asked both sides of the petition to dispose of the rule after hearing at the HC.
Barrister Masood R Sobhan and Barrister Fatema S Chowdhury appeared for the petitioner.
