A Supreme Court lawyer today served legal notices to a minister and two state ministers, asking them to vacate their offices by November 15 for holding the posts reportedly “in violation of the constitution”.

Advocate ZI Khan Panna issued three separate notices to Housing and Public Works Minister Eng Mosharraf Hossain, State Minister for Health Zahid Maleque and State Minister for Land Saifuzzaman Chowdhury, stating that they are holding different profitable posts.

Article 147 of the constitution clearly prohibits a minister and a state minister from holding any office, post or position of profit or emolument, he said in the notices.

Mosharraf is chairman of Peninsula Chittagong Limited, a limited company, Zahid is holding the post of member of board of directors of Sunlife Insurance Company Limited and Bangladesh Thai Aluminum Company Limited, and Saifuzzaman is a member of board of directors of Aramit Cement Limited, a limited company, according to the notice statements.

Advocate Shahdeen Malik served the legal notices on behalf of Panna saying that appropriate legal action would be taken against them if they do not quit the posts of minister and state ministers.

Earlier on Thursday, he served a similar legal notice on Water Resources Minister Anisul Islam Mahmud, who is reportedly holding the posts of director and chairman of Shasha Denim Limited, and Energies Power Cooperation Limited.
