Think Legal presents its 8th lecture
Think Legal Bangladesh is an online legal resource platform dedicated to the dissemination of legal knowledge and a free crowd-sourced platform to make legal information more accessible and to generate new legal content in Bangladesh. It is a collaborated effort of numerous lawyers and legal scholars who have contributed their time, effort and work product to be show-cased & shared on the platform & who share a common purpose of making legal knowledge more accessible.
Think Legal Bangladesh organized their inaugural lecture series in January 2015 at Dhaka’s EMK center. The latest lecture, the 8th Lecture in the Think Legal Bangladesh Lecture Series was delivered by Hon'ble Madam Justice Kashefa Hussain, Hon’ble Judge of the High Court Division of the Supreme Court of Bangladesh on 3rd November 2018 at 11 a.m. at the EMK Center, Dhanmondi, Dhaka on the topic: “Laws, Special Laws and Effects”. The lecture drew a full-house and was attended by respected members of the Bench and Bar, academicians and students. Attendance continued to grow even as the lecture progressed.
Justice Hussain’s lecture covered a wide array of laws from family laws to digital security laws to illustrate the effects of special law regimes on the dispensation of justice, namely that special laws are often “rigidly stringent enactments” and they often have “discriminatory effects leading to a lack of fairness, and failure to ensure “Justice” within its proper definition.” Madam Justice Hussain warned that an imbalance in the laws escalate misuse of the laws, which she added, are impediments to good governance and rule of law. Commenting further, she pointed out that special law regimes often defy notions of reasonableness and logic when equal forms of punishment are meted out for offences that are starkly dissimilar. Justice Hussain ended by stating that the objectives of special law regimes is to strike a balance between creating effective and sustainable deterrence against committing offences on one hand while ensuring strictly that the fundamental rights of any citizen or person as is guaranteed under the Constitution are not unduly violated.
