HC orders to probe negligence over postmortem report in Gazipur murder case

The High Court today expressed dissatisfaction with the authorities concerned of Dhaka Medical College Hospital (DMCH) and Shahbagh Police Station for their negligence in releasing and receiving the postmortem report in connection with Gazipur's Al Amin murder case.

"The incident of killing (Al Amin) took place in November 2019. Forensic department of DMCH said it sent the postmortem report to Shahbagh police on November 9 last year, but the police claimed that they received the postmortem report on March 24 this year. There are negligence, anomalies and irregularities in this matter. The negligence and irregularities need to be probed," the HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman observed.

The bench also said, "It is difficult for us to work if the officials concerned don't discharge their responsibilities properly."        

With this observation, the HC bench ordered the authorities concerned to conduct an enquiry into the negligence and irregularities in releasing and receiving the postmortem report.

The director of Dhaka Medical College and commissioner of Dhaka Metropolitan Police have been asked to form an enquiry committee to find out the people responsible for the negligence and to take appropriate action against them.

The HC bench issued the order during hearing a petition filed by one Md Habibur Rahman, an accused of the case, seeking bail. The court also rejected the bail petition.

During the hearing, Dr Sohel Mahmud, the then head of forensic department at DMCH, appeared before the HC bench today in compliance with its March 16 order and told the court that his office sent the report to Shahbagh police on November 9 last year.

Deputy Attorney General Sarwar Hossain Bappi told the HC bench that he talked to the officer-in-charge of Shahbagh police station last night and the OC informed that his office received the postmortem report from DMCH's forensic department on March 24 this year.   

Al Amin from Tongi in Gazipur was killed on November 7, 2019. Postmortem of the body was conducted at the DMCH the following day.

A murder case was filed with Tongi Police Station on November 8, 2019 against Habibur and other accused in connection with the incident.
