HC debars corruption accused from seeking bail for 4 months for fraudulence

The High Court today debarred a corruption accused, Nur Mohammed, from seeking bail from any court of Bangladesh for next four months for committing fraudulence with the court by suppressing fact of securing rule twice over his bail in the same case.

After going through the documents and hearing arguments, the HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman said the incident of suppressing information of securing rule over bail for two times from the court in connection with the same case is an act of fraudulence.

Such incidents of suppressing facts with the court are happening very often as the affluent accused try to get relief from the court by spending huge amount of money, the HC bench said, adding that such incidents of fraudulence must be stopped.

The HC rejected the rules issued earlier asking the state why Nur Mohammed should not be granted bail in the corruption case filed against him.        

Law enforcers detained Nur Mohamed and Sarwar Alam Khan, two employees of Savings Department of General Post Office (GPO) in Chattogram, on charge of embezzling Tk 45 lakh from clients.

Mohammed admitted the embezzlement of money and Tk 21.49 lakh was recovered from him in two phases.

Later on, the Anti-Corruption Commission filed a corruption case against them with Chattogram Metropolitan Sessions Judge's court for the embezzlement of the money.

Following a bail petition of Nur Mohammed, the HC on December 10 last year issued a rule asking the state why the petitioner, Nur Mohammed, should not be granted bail in the case.

Lawyer Aneek R Haque appeared for him during hearing bail petition on December 10.

By suppressing this information, Nur Mohammed further sought bail from the HC bench on January 21 through another lawyer SM Muktadir Rahman Khan.

The bench on January 21 issued another rule asking the state why Nur Mohammed should not be granted bail in the case.

Having a confusion over this issue, Deputy Attorney General Sarwar Hossain Bappi collected all the documents including the copy of the HC order of rule issued on December 10, and he placed those to the HC bench today.

Today, Nur Mohammed's lawyer Muktadir told the HC bench that he moved the bail petition on behalf of his client to the HC based on the documents supplied by his client.    

Lawyer Aneek R Haque told this correspondent that today's HC order is an exemplary instance for the frauds.
