The High Court today questioned the legality of holding office of member of parliament by chief whip ASM Feroz following a petition regarding an alleged loan scam.
The court sought explanation from the government, Election Commission and ASM Feroz, ruling party lawmaker from Patuakhali-2 constituency, in this regard in four weeks.
The bench of Justice Salma Masud Choudhury and Justice Habibul Gani issued the rule following a writ petition filed by Zia Ul Haq, municipality mayor of Baufal.
The petitioner said ASM Feroz did not reschedule his bank loan in time as declared by the Representation of the People Order (RPO).
According the RPO provision, an MP candidate was supposed to reschedule the bank loan by November 24, 2013 for contesting the election of January 5.
But ASM Feroz has rescheduled his bank loan on November 27, 2013 for which he was not qualified to contest the election, according to the petitioner.
The writ petitioner prayed to the High Court to declare the candidacy of ASM Feroz illegal on loan default charge and to declare the Patuakhali-2 constituency vacant.
