SC allows 110 BSMMU doctors to move appeals

The Supreme Court today allowed 110 doctors to move appeals against a High Court verdict that declared their appointment as medical officers of Bangabandhu Sheikh Mujib Medical University (BSMMU) illegal.

The apex court asked the doctors to submit concised statements of their appeals before the court in four weeks after the SC’s reopening on October 30 following its annual vacation.

The court also asked the BSMMU authorities to submit their concised statement on the appeals in two weeks after the doctors place their statements.

A concised statement contains the point on which arguments are placed in an appeal.

A five-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha passed the order after hearing the five separate petitions filed by the doctors.

The doctors filed the petitions seeking review of its February 22 order that rejected their lead to appeal petition against a High Court verdict that in 2010 had declared their recruitment process illegal for anomalies.

Dr Sharif Bhuiyan, a lawyer for the doctors, told The Daily Star that the Supreme Court, after hearing the appeals, might decide whether his clients can remain in their services.

The Supreme Court on August 29 sought opinions from Attorney General Mahbubey Alam on how to keep the qualified doctors among 111 who were appointed at Bangabandhu Sheikh Mujib Medical University (BSMMU) as medical officers in 2006, in service.

The apex court asked him to submit the opinions to it after discussing with the BSMMU authorities.
