Document forgery to get bail: HC asks registrar to file criminal case against 3, including 2 policemen

The High Court has found two police constables and one other person to have committed forgery by making false, manipulated documents and submitting them to secure bail of a rape convict in Jhenidah.

After examining the original and forged documents, the court today directed its registrar to file a criminal case against police constables Bishwajit alias Babu and Khairul, who were on duty at Jhenidah Jail, and Chandali Biswas, whose sworn affidavit was used to file the appeal seeking bail for rape convict Kabir Biswas.

Kabir was sentenced to life imprisonment by the trial court.

Constable Bishwajit has been transferred to Kushtia and Babu is discharging duties at Jhenidah jail, Kabir Biswas's lawyer Sheikh Atiar Rahman said.

The HC said the investigation officer of the criminal case will implicate others found involved with the forgery after inquiry.

The bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman made the order after hearing an appeal filed by Kabir Biswas seeking bail in the case filed in 2013 for rape under Section 9(1) of Nari O Shishu Nirjaton Daman Ain, 2000.

Describing the facts, Deputy Attorney General Sarwar Hossain Bappi said Nari O Shishu Nirjaton Daman Tribunal of Jhenidah on July 8, 2015 convicted Kabir Biswas and sentenced him to life imprisonment and fined him Tk 2 lakh for the crime.

Without complying with the tribunal verdict, Kabir, who is now in jail, filed an appeal with the HC challenging the tribunal verdict and sought bail from the HC twice in the case. The HC on January 25 and May 30 in 2018 rejected his bail petitions.

On September 15 this year, Advocate Sheikh Atiar Rahman, a Supreme Court lawyer, appeared for Kabir before the HC bench and placed some documents before it seeking bail for Kabir.
