HC seeks explanation from Narial judge for exempting prime accused

The High Court today ordered the district and sessions judge of Narail to explain why his judicial powers should not be curtailed for exempting the main accused of a sensational murder case.

The court asked the district and sessions judge submit his explanation before it by July 30.

The HC bench of Justice M Enayetur Rahim and Md Mostafizur Rahman passed the order on a suomoto (voluntary) move during hearing a petition filed challenging the district and sessions judge’s exemption order.

Assistant Attorney General (AAG) Md Yousuf Mahmud Morshed told The Daily Star that one Enamul Haque was shot dead at Barnail Bazar area under Kalia Police Station in Narail on February 10, 2015.

The following day, Enamul’s brother Nazmul Huda filed a case with Kalia Police Station against 68 persons including a Mallick Mazharul Islam alias Maza.

In the case statement, he said Mallick Mazharul Islam alias Maza ensured the death of his brother Enamul by firing three bullets on his body.

The district and sessions judge of Narail on June 10 this year framed charges in the case exempting Mallick Mazharul Islam alias Maza from the charges.

Nazmul Huda recently filed a petition with the HC challenging the district and sessions judge’s order. In the petition, he prayed to the HC order the trial court judge to include Mallick Mazharul Islam in the case, AAG Morshed said.

After examining the petition, the HC today issued the show cause to the Narail judge and fixed July 30 for hearing and passing further order on this issue, he added.
