SC hearing on DNCC by-polls stay order Feb 8

The Supreme Court (SC) today fixed February 8 for hearing a leave-to-appeal petition filed by the Election Commission (EC) seeking stay on the High Court order that halted the process for holding the election to Dhaka North City Corporation (DNCC) for six months.

After fixing the date, Chamber Judge of the Appellate Division Justice Hasan Foyez Siddique sent the petition to the full bench of the apex court for its hearing.

The chamber judge came up with the decision after a brief hearing on the petition. The EC on January 31 submitted two separate leave-to-appeal petitions to the SC against the HC stay order.

Today, one of the two petitions was placed before the chamber judge’s court for its hearing.

The EC filed two separate leave-to-appeal petitions with the Supreme Court seeking a stay on the HC order that has halted the process for holding DNCC by-election.

Following two separate writ petitions, the HC on January 17 stayed for six months the process of the DNCC polls that was scheduled to take place on February 26.

The HC issued two rules asking the authorities concerned of the EC and the government to explain in four weeks why this schedule should not be declared illegal.
