Grant selection grade to 3 asstt teachers: HC

The High Court has directed the government to grant the selection grade and time scale to three assistant teachers of separate government secondary schools as per the relevant provisions of the Services (Pay and Allowances) Order 2009.

The three teachers are Md Abdus Salam, Ayesha Ferdous Taher, and Babul Akter -- whose selection grade and time scale were excluded by a provision of the Services (Pay and Allowances) Order 2015.

Following three separate writ petitions filed by the aggrieved teachers, the HC ordered the authorities concerned of the government to grant the selection grade and time scale to them within three months after receiving copy of the verdict.

The HC bench of Justice Md Ashfaqul Islam and Justice Mohammad Ali announced the verdict on May 2 this year, and its full text was released on August 21.

“We are of the view that since the petitioners were appointed before the Services (Pay and Allowances) Order 2015 came into play. The terms and conditions of their service are regulated and controlled under the Services (Pay and Allowances) Order 2009 and the omission and exclusion of time scale and selection grade in the 2015 order is disadvantageous to the petitioners,” the bench said in the full text of the verdict.

Petitioners’ counsel Advocate Mohammad Ibrahim Khalil told the court that as per para 7(2) and 7(9) of the Services (Pay and Allowance) Order, 2009, the second class gazetted officers will be entitled to a selection grade on satisfactory completion of four years of service; first time scale on completion of eight years’ service, and second time scale on completion of twelve years’ service from the date of joining.

The petitioners have satisfactorily completed the required length of service without any promotion since their appointment, he said.

The counsel said the petitioners are entitled to the selection grade and time scale as the relevant provisions of the National Pay Scale, 2009.
