HC stays eviction order of 5 establishments in Gulshan, Banani

The High Court today issued a restriction order on eviction of two schools, two hotels and a guest house from Gulshan and Banani areas in Dhaka for different periods.

The five structures are Aurara International School at Gulshan-2 and Scholastica Limited at Gulshan North Avenue, Coffee World at Banani, Hotel Amari at Gulshan-2 and Holiday Planet (guest house) at Gulshan-2, Deputy Attorney General Mokhlesur Rahman told The Daily Star.  

In response to five separate writ petitions, the HC, however, ordered the authorities concerned of the schools, hotels and guest house to shift their structures from the areas within different periods.

The authorities also ordered to take proper security measures at the schools, hotels and guest house until they are relocated, DAG Mokhlesur said.

He also said Aurara International School and Scholastica School have to be relocated by December 31 and the hotels and guest house have to be shifted in three months.

The HC also issued five separate rules asking the authorities concerned of Rajdhanai Unnayan Kartripakkha (Rajuk) and government to explain in four weeks as to why the eviction of the structures without any notice and without giving them sufficient time should not be declared illegal.

The HC bench of Justice Quamrul Islam Siddique and Justice Razik-Al-Jalil came up with the order and rule following five separate writ petitions filed by the authorities concerned of the schools, hotels and guest house.

They recently submitted the petitions seeking directives from the HC on the government and Rajuk not to evict them without issuing notices and without giving them sufficient time.   

According to Rajuk a total of 342 restaurants, 62 residential hotels and guest houses, 16 bars, 56 schools, 3 colleges, 23 universities, 50 hospitals and medical centers have been operating illegally at the Gulshan, Banani and Baridhara areas.

Earlier, the government has issued notices to 13,000 commercial establishments in residential areas under city corporations across the country.
