Move to empower JS to impeach judges challenged
A lawyer today filed a writ petition seeking High Court directive on the government not to amend the constitution for empowering parliament to impeach Supreme Court judges.
Supreme Court lawyer Eunus Ali Akond in the petition also prayed to the HC to order the government to maintain status quo on the reported decision about changing Article 96 of the constitution.
The petition stated that the government has reportedly decided to bring amendment to the constitution incorporating provision to empower Jatiya Sangsad to impeach SC judges.
The lawyer described the Article 96 as a basic structure of the constitution which cannot be changed as per Article 7 (B) of the charter.
If parliament is given power to impeach the judges, the independence of judiciary will be damaged and the judges will remain under pressure, he said.
Eunus prayed to the court to issue a rule upon the government to explain why the reported move would be declared illegal.
Eunus told The Daily Star that the High Court may hear the petition tomorrow.
