HC rejects petition for removal of structures
The High Court yesterday rejected a writ petition filed for the removal of illegal structures from Dhanmondi-8 public playground in the capital.
The HC bench of Justice Quazi Reza-Ul Hoque and Justice ABM Altaf Hossain passed the order, considering the petition was not placed before it for a hearing.
Earlier in the day, the petitioners' counsel Ramzan Ali Sikder told the bench led by Justice Hoque that they didn't want to move the petition before it, as a similar petition is pending with another HC bench.
Six environmentalists have collectively filed the writ petition, seeking the HC's directives on the government to remove the illegal structures from the playground and ensure the commoners' access to the open space.
The playground was opened to the public on April 24, days after protests by green activists. But the structures built by Sheikh Jamal Dhanmondi Club, which had illegally occupied the field for two years, stayed there as before.
On May 4, an HC bench of Justice Farah Mahbub and Kazi Md Ejarul Haque Akondo refused to deal with the petition after one of its judges felt embarrassed to hear arguments on it. The bench then sent the petition to the chief justice.
Chief Justice Md Muzammel Hossain on May 8 assigned the bench of Justice Quazi Reza-Ul Hoque and Justice ABM Altaf Hossain to hear the petition and dispose it.
On April 28, another HC bench of Justice Salma Masud Chowdhury and Justice Md Habibul Gani had refused to hear the same petition.
