Produce prisoners without handcuffs, fetters: HC
The High Court today cautioned two high officials of prisons not to produce any prisoners before any courts in handcuffs and fetters in future.
The prisoners can be brought to the court in fetters and handcuffs for the interest of security, but they cannot be produced in courtrooms in such manner, the HC said.
The HC bench of Justice Obaidul Hassan and Justice Krishna Debnath came up with the ruling after Deputy Inspector General of Prisons (DIG-Prisons) in Dhaka Touhidul Islam and Senior Jail Super of Keraniganj Jahangir Kabir appeared before it and explained the reasons behind sending four under-trial prisoners to the court in fetters on February 23.
During hearing a suo moto rule, the bench on February 23 summoned the prisons officials to appear before it for explaining why four under-trial prisoners were sent to the court in fetters on that day.
The four prisoners are Habibur Rahman, Moniruzzaman, Nasiruddin and Giasuddin, who have been suffering in jail for more than 10 years in separate criminal cases including killing cases.
DIG-Prisons Touhidul Islam told the court that he was sorry as police brought the prisoners in fetters before the HC on February 23. He said it will not happen in future.
Jail Super Jahangir Kabir told the HC that police fettered the four under-trial prisoners while producing them before the HC as the prisoners have connection with banned militant outfit Jama'atul Mujahideen Bangladesh (JMB).
On February 23, the HC passed different orders including granting bail in respect of the cases against the four prisoners.
