HC justifies three sections of Vested Property Return Act
The High Court yesterday justified three sections of the Vested Property Return Act, 2001 regarding government's authority to prepare list of vested property, relevant tribunals' jurisdiction to dispose of cases relating to such properties and deputy commissioners' power to maintain and leasing those properties.
The court said the sections 9, 13, and 14 of the act are not contradictory to the constitution and fundamental rights of the citizens.
Following the HC verdict, the government can prepare list of the vested property, only the vested property related tribunals will dispose of the cases involving such properties and deputy commissioners will have the authority to maintain and lease out those properties, senior advocate Manzill Murshid, counsel for the land ministry, told The Daily Star. A larger bench of the HC comprising Justice Naima Haider, Justice Shahidul Karim and Justice S M Kuddus Zaman delivered the verdict after rejecting two petitions challenging the legality of Sections 9, 13, and 14 of the Vested Property Return Act, 2001.
He also said all the cases regarding the vested properties will be dealt with by the designated tribunals and such cases pending with other civil courts will become abated as per the law and the HC verdict.
A larger bench of the HC comprising Justice Naima Haider, Justice Shahidul Karim and Justice S M Kuddus Zaman delivered the verdict after rejecting two petitions.
Details of the HC verdict could not be known as its full text was not released yet.
