Man in jail for 6 years even after acquittal: HC orders judicial probe
The High court today (August 7, 2022) directed its registrar to conduct a judicial enquiry into a reported incident of detaining Abul Kashem, a man from Lohagara in Chattogram, in the prison even after the court had acquitted him from a murder case six years ago.
The HC asked its registrar to submit the judicial enquiry report by August 25.
The bench of Justice Jahangir Hossain Selim and Justice Md Bashir Ullah passed the order following a petition filed by Supreme Court lawyer Mohammad Shishir Manir seeking necessary directives on the issue.
He submitted the petition based on a report published on banglanews24.com on July 27.
According to the report, Abul Kashem has been languishing in Chattogram Central Jail even after six years of his acquittal in a murder case since the HC verdict copy is yet to reach the jail. The HC pronounced the judgement in 2016.
A total of 12 people, including Kashem, were sentenced to death in 2007 for killing one Jane Alam in 2002.
After hearing the death reference of the case, the High Court in 2013 had found Kashem not guilty in the murder. But in a part of the verdict, the HC did not mention his acquittal. Later, in 2016, the court corrected the verdict and acquitted him.
According to the report of banglanews24.com, the copy of the HC verdict has not yet reached Chattogram jail authorities.
