Jhumon’s Bail: HC to issue order on bail tomorrow
The High Court yesterday set Thursday for delivering its order on a petition filed seeking bail for Jhumon Das Apon, who has been languishing in jail for more than six months in a case filed under the controversial Digital Security Act (DSA) for criticising Hefajat-e-Islam leader Mamunul Haque on Facebook.
The bench of Justice Mustafa Zaman Islam and Justice KM Zahid Sarwar Kajol fixed the date while holding hearing on the bail petition.
Jhumon Das's mother Nibha Rani Das filed the petition seeking bail for her son saying that he has been suffering in jail for a long period without any trial.
Appearing for the petitioner, senior lawyer ZI Khan Panna told the HC that Jhumon Das is a patriot, not a traitor, as he spoke about the communal force, which is the real traitor. The DSA case should have been filed against that communal force, not Jhumon Das, he argued.
Assistant Attorney General Md Mizanur Rahman told this correspondent that he could not place arguments before the court as he was not supplied with the case records.
Lawyers Nahid Sultana Juthi and Ashraf Ali also appeared for the petitioner.
Police, with the help of locals, detained Jhumon Das on March 16 to pacify agitated Hefajat supporters and avoid a possible attack on their village, but in vain.
Jhumon Das, 25, was shown arrested under Section 54 of Criminal Procedure Code (CrPC) and produced before a Sunamganj court on March 17.
The court later sent him to jail.
His Facebook post allegedly led to mayhem in Noagaon village of Sunamganj's Shalla upazila on March 17, which saw about 90 Hindu houses vandalised and looted.
On March 22, police lodged the case against the youth and 20-30 unnamed persons under the DSA. In the case statement, they attached a copy of Jhumon Das's Facebook post and mentioned that he intentionally spread information which is aggressive, intimidating, false and disgraceful in nature, and responsible for degrading law and order.
They also mentioned that Jhumon Das in his Facebook post attached a defamatory photo of Mamunul Haque and three posts targeting the Hefajat leader.
A Sunamganj court on April 20 placed Jhumon Das on a two-day remand in the DSA case. Police remanded him into custody and sent him back to jail.
