HC issues injunction on construction of multi-storeyed buildings on Kalyanpur playground
The High Court issued an injunction today refraining authorities concerned from constructing multi-storeyed apartment buildings on a piece of land allocated as a playground and community space in the capital's Kalyanpur.
The injunction will be in place for 30 days or till the reopening of the court, whichever is earlier, the HC said.
The HC bench of Justice M Enayetur Rahim came up with the order following a writ petition filed by Kallayanpur Estate Bahumukhi Samabaya Samity Limited of Kallayanpur Housing Estate seeking necessary directives to stop construction.
In the petition, the organisation challenged the legality of constructing multi-storeyed apartment buildings on 10.12 acres of land allocated as a playground and community space.
Citing the petition, the petitioner's lawyer Imtiaz Uddin Ahmad Asif told The Daily Star that Biswas Builders, a development company, on June 30 started constructing two multistoried apartment buildings on the playground and community space with approval from Jatiya Grihayan Sangstha (National Housing Authority), damaging the residential character of the area and the peaceful possession of the petitioner's property.
The approval of construction is in direct contradiction to the government's commitment to providing a playground and green area in each locality, and the construction will deprive families and members of Kallayanpur Estate Bahumukhi Samabaya Samity Limited of light, air, and other benefits of living in a residential area, he added.
Deputy Attorney General Bipul Bagmar represented the state during the virtual hearing of the writ petition.
