9 cops sued over custodial death of BNP leader in Rajshahi
Nine policemen have been sued over the custodial death of a BNP leader in Rajshahi seven years ago.
Wife of the victim, Morzina Rahman of Rajshahi city, today filed the case with the Metropolitan Sessions Judge's Court, reports our Rajshahi staff correspondent, quoting one of her counsels Parvez T Zahedy.
Her husband Ainur Rahman Mukta, who was the joint convenor of BNP unit at city's Ward 14, died in police custody in 2015.
The accused include Md Shamsuddin, a former commissioner of Rajshahi Metropolitan Police (RMP) who retired in 2020.
Three other accused are -- Nur Hossain Khandaker, the then OC of Boalia Police Station; Ashikur Rahman, the then OC of Detective Branch (DB) of RMP, and Touhidul Islam, the then SI of Boalia Police Station.
Five other accused are unnamed police members.
The court recorded the statement of the plaintiff, but was yet to give any order on the filing of the case, said Mosabbirul Islam, the public prosecutor (PP).
The case was filed only to embarrass the government, he added.
According to case statement, police picked up Mukta from his house at Uposhohor Housing Estate on January 27, 2015.
He was produced before the court the same day after he was tortured at the police station. The court then sent him to jail, according to the case statement.
Later in the day, Mukta was declared dead by doctors at Rajshahi Medical College Hospital when he was taken to the hospital by the jail authorities, the case says.
Mukta was buried without an autopsy under tight police vigilance, the case says.
The plaintiff's lawyer Zahedy said, Mukta was arrested over a political case and he died due to physical and mental torture in police custody.
The case was filed under the Torture and Custodial Death (Prohibition) Act of 2013, he said, adding that the filing of the case was delayed as the plaintiff was scared to file the case. There was also delay in finding information and data.
