Hearing on leave to appeal petitions likely today
The Supreme Court (SC) may hold hearing today on the leave to appeal petitions against the High Court (HC) judgment that had declared illegal the 5th Amendment to the Constitution endorsing late president Ziaur Rahman's takeover and previous acts from August 15, 1975.
The petitions have been enlisted for hearing on today's (Sunday) cause list of the Appellate Division.
On August 29, 2005, the HC upon a writ petition declared the 5th Amendment to the Constitution illegal, meaning the rules of Khandaker Mushtaque Ahmed, Abu Sadaat Mohammad Sayem and Maj Gen Ziaur Rahman from August 15, 1975 to April 9, 1979 were unlawful.
The Appellate Division on September 1, 2005 following a government prayer stayed the HC verdict.
The BNP-Jamaat coalition government and Bangladesh Muktijoddha Kalyan then filed two separate leave-to-appeal petitions with this court (SC) against the HC verdict.
