HC rejects bail petition of Aziz
The High Court (HC) yesterday rejected a petition filed by former Dhaka City Corporation (DCC) ward commissioner Abdul Aziz seeking bail in the sensational Lalbagh seven-murder case.
Aziz was sentenced to 12 years' imprisonment by the trial court in the case.
Deputy Attorney General (DAG) Motahar Hossain Sazu yesterday told The Daily Star that the HC bench of Justice Md Imman Ali and Justice Syeda Afsar Jahan rejected the petition considering as it (petition) was not placed for hearing before the court.
He said the court passed the order, as Advocate Shaikh Atiar Rahman, lawyer for Aziz, prayed to the court not to proceed with the petition.
Sazu told the court that Aziz had suffered in jail for only two years five months and 11 days, but in the bail petition it was stated that he has already suffered about six years.
He also verbally prayed to the court to take action against Shaikh Atiar Rahman for misleading the court by making false statement regarding the number of days Aziz passed in the jail.
The court, however, did not pass any order of action against Atiar, as he took back the bail petition, Sazu said.
On April 9 this year, the HC has granted him ad-interim bail for three months upon a petition filed by Aziz stating that he is a man of 55 years and he has already served about seven years in jail.
The petition, upon which the HC has granted him bail, was found missing on Sunday.
The HC on the same day recalled its bail order and also allowed Aziz to file a fresh petition for bail in this case.
The fresh bail petition was filed on Monday afternoon.
