BERC Chairman HC verdict stayed
The Supreme Court yesterday stayed for six weeks a High Court verdict that declared illegal the appointment of Syed Yusuf Hossain as chairman of Bangladesh Energy Regulatory Commission (BERC) and his holding this office.
Chamber Judge of the Appellate Division Justice SK Sinha passed the order after hearing a petition filed by Yusuf seeking stay on the HC verdict.
The judge also asked Yusuf to file a regular leave-to-appeal petition with the SC against the HC verdict within six weeks' period.
Yusuf's lawyer Barrister M Amir-Ul Islam told The Daily Star that there is no legal bar to his client to discharge duties as BERC chairman for next six weeks following the chamber judge's order.
Following a writ petition, the HC on February 24 declared the appointment of Yusuf as chairman of BERC and his holding this office illegal and unconstitutional.
Syed Yusuf Hossain, former comptroller and auditor general, was appointed chairman of BERC for three years on October 11, 2009, and he joined the office on October 13 the same year.
