Khaleda Zia moves to challenge HC verdict
BNP Chairperson Khaleda Zia yesterday filed an appeal with the Supreme Court (SC) to overturn the High Court (HC) verdict that had upheld the government's notice asking her to vacate the cantonment residence.
Chamber Judge of the Appellate Division, Justice Md Muzammel Hossain fixed Tuesday (today) for hearing the appeal.
Barrister Mahbubuddin Khokon filed the leave to appeal petition on behalf of the opposition leader.
The appellant prayed to the SC to stay the HC order that on October 13 also directed Khaleda to vacate the abode at Shaheed Mainul Road within 30 days.
The stipulated time comes to an end on November 12.
The appeal states that the HC judgment did not follow the existing laws and earlier examples of the SC verdicts in similar cases.
As per the records, the residence falls under B-4 category of cantonment board's property, which can be leased to a civilian, the petition said, adding a number of former army persons and civilians have been residing in the area under the same category.
Advocate TH Khan, chief counsel for BNP chairperson, prayed to the chamber judge for early hearing of the appeal, saying the matter is important.
