Probe imprisonment of man in likely case of mistaken identity: HC
The High Court today ordered the chief judicial magistrate of Chapainawabganj to immediately conduct an inquiry into the jailing of a man, who reportedly shares a name with the accused in a drug case.
The court also asked the magistrate to take necessary measures to release the youth from jail if he is found innocent in the inquiry.
The HC bench of Justice M Enayetur Rahim passed the order on a suo moto (voluntary) move following a report published in the daily Jugantor today over the incident.
The report detailed how a man named Rubel Ali alias Rubel Babul was initially arrested, then released on bail before he went missing, and another man named Md Rubel was later arrested and has since been languishing in jail. The fathers of both men also have similar names.
As per the Jugantor report, police detained Rubel Ali alias Rubel Babul, 26, on April 6, 2018, in a case under the Drugs Control Act with Shibganj Police Station.
Five days later, Rubel Babul -- son of Mantu Ali of Kadamtola village under Shibganj upazila -- was released on bail. Later, Rubel went missing, according to the report.
On July 20 of the same year, police submitted the charge sheet to the court against Rubel Babul. The court then issued an arrest warrant against him.
However, on March 10 this year, police arrested Md Rubel, 23, son of Md Montu of a nearby village of Kadamtola in the case. Since then, Md Rubel has been suffering in jail, the Jugantor report said.
Supreme Court lawyer Mohammad Shishir Manir placed the report through email before the High Court bench for necessary directives on the authorities to release Md Rubel, now in Chapainawabganj jail.
