HC questions EC's demarcation of Kurigram-4
The High Court today questioned the legality of the Election Commission’s decision for demarcating Kurigram-4 (Roumari-Rajipur) constituency including Chilmari area.
The court issued a rule asking the commission and the government to explain in four weeks why the gazette notification issued by the EC on June 10 this year determining Kurigram-4 constituency including Chilmari should not be scrapped.
Chief election commissioner, secretary to the EC, deputy commissioner of Kurigram district and regional election officers concerned have been made respondents to the rule.
The HC bench of Justice Md Nazrul Islam Talukder and Justice Shahidul Karim came up with the rule following a writ petition filed by Kurigram’s Rajipur Upazila Awami League’s President Abdul Hye Sarkar, challenging the legality of the EC’s gazette notification.
Writ petitioner’s lawyer Advocate Syed Mamun Mahbub told The Daily Star that the EC has to consider the communication and geographical position of the areas during delimitation of any parliamentary constituency as per their rules.
Chilmari is situated on the another side of Brahmaputra River from Roumari-Rajipur area and Chilmari is remote area, he said, adding that the EC itself had correctly excluded the area from Kurigram-4 (Roumari-Rajipur) constituency in 2013.
Advocate Mamun Mahbub said influenced by a vested quarter the EC has issued a gazette notification on June 10 on Kurigram-4 (Roumari-Rajipur) constituency including Chilmari in violation of the EC rules.
The lawyer also said they would take all necessary steps for hearing the HC rule before August 14.
