Pvt cars, CNG rickshaws, taxis can't be requisitioned by cops: HC
Police cannot requisition private cars, CNG-run auto-rickshaw and taxi, the High Court said today.
The HC issued nine directives on police over the requisitioning of vehicles.
All requisition of vehicles must be for the public interest and if it is not for public interest, legal action must be taken against the responsible police officer, it said.
The requisitioned vehicle cannot be used for the officer’s personal or family purpose. If the requisitioned vehicle is used for personal and family purpose of any police officer, that will be a misconduct and appropriate action must be taken to this effect.
If any allegation is filed about requisition of transport, the metropolitan police commissioner will investigate and take necessary action. The High Court said, a vehicle cannot be requisitioned more than one time in six months.
The HC said that if any requisitioned transport is damaged then the police will compensate the owner of the vehicle.
All police officials must preserve a list of the requisitioned vehicles.
The transport carrying women, children and patients cannot be requisitioned. Dhaka Metropolitan Police Commissioner will issue a circular that the police officer follow the directive.
The HC bench of Justice Naima Haider and Justice Khijir Ahmed Chowdhury came up with the verdict after hearing writ petition moved by Advocate Manjill Murshid on behalf of Human Rights and Peace for Bangladesh.
