Why inaction to build pedestrian crossing not illegal
The High Court has questioned the inaction of the government in building a footbridge or an underpass between Matsya Bhaban and Bangladesh Bar Council Bhaban in Dhaka for pedestrians.
The HC in a rule on September 16 asked the respondents to explain as to why their inaction to construct a footbridge or an underpass between the buildings should not be declared illegal.
Secretaries to the local government and rural development ministry as well as Bangladesh Road Transport Authority, the mayor of Dhaka South City Corporation (DSCC) and the chief engineer of public works department were made respondents to the rule.
The bench of Justice Sheikh Hassan Arif and Justice Ahmed Sohel delivered the rule after hearing a writ petition filed earlier in the month by Advocate MA Kashem, a Supreme Court lawyer.
The HC also asked the DSCC to dispose of an application -- by the same petitioner on February 15 last year -- in which a request for building a footbridge or underpass in the same area was made to DSCC.
In the petition to HC, Kashem sought necessary order from for constructing a safe passage over or under the roads between Matsya Bhaban and Bangladesh Bar Council Bhaban as a lot of pedestrians cross the busy intersection of three roads every day.
